Dementia: how the law can help you and your loved ones plan for the future

It’s estimated nearly one million people are living with dementia in the UK. By 2040, it will be nearer 1.4 million. Why estimated? One in three people living with dementia have not been formally diagnosed with dementia, which is vital for accessing support. 

Dementia is a progressive condition, but early support can make a big difference. According to the Alzheimer’s Society, 91% of people affected by dementia say there are benefits to getting a diagnosis, such as being prescribed medications to alleviate some symptoms.

Ensure your wishes are respected

If you or a loved one has dementia, it’s important to start planning for the future as soon as possible. The team at Attwaters Solicitors can provide advice on a range of practical and legal steps. This could include:

  • Agreeing an advance care plan: set out your wishes for medical and personal care, such as moving to a nursing home.
  • Granting lasting power of attorney: appoint people that you trust to make financial and healthcare decisions on your behalf.
  • Writing or rewriting a will: lodge a copy with a solicitor or the Probate Service. It can be very difficult to make changes once a person has lost capacity.
  • Sharing an advance decision: specify any treatments that you want to refuse in the future, such as life-sustaining care. Also known as a living will.

As well as seeking legal advice, remember to discuss your plans and wishes with loved ones. This will make it easier to manage care arrangements and finances when the time comes.
