Out of court solutions for separating parents

If you’re going through a separation, resolving child arrangements outside of court can be quicker, less confrontational and more cost-effective. These processes give you greater control and often help preserve co-parenting relationships, which benefits your children in the long term. In this blog, we outline some options for alternative dispute resolution.

Mediation

All couples are required to consider mediation before taking their case to court, unless certain circumstances justify not attending. With this approach, a trained and Independent Mediator will assist the couple through the negotiation process, helping them to reach an agreement in a non-hostile and more informal setting. Children over ten years old can also be included in the process.

Attwaters offers a Mediation Support Service, ensuring you feel confident throughout the mediation process and negotiations. Once an agreement has been reached, we can then prepare a court order to record your decision. 

Arbitration

Arbitration is similar to going to court but offers greater privacy and more control over the process. It can help you reach decisions about money and childcare arrangements. As a couple, you would appoint an Independent Arbitrator to act in the capacity of a Judge. They will collect the relevant facts and evidence to make a legally binding decision. Arbitration gives separating couples certainty, knowing a decision will be made without the delay and expense of court proceedings.

Private Financial Dispute Resolution (FDR) appointments

Private FDR Appointments are a great option when you need the convenience of making arrangements that suit you. You will book a dedicated judge for a full day, improving the chances of reaching a settlement and avoiding lengthy court timetables.

Round table meetings

In a round table meeting, you and your former partner can come together with solicitors to resolve issues without a Judge, Mediator or Arbitrator. This format encourages you to have open and direct conversations in order to reach an effective negotiation.
